Devine Imageworks Policies
CANCELLATION/ RESCHEDULING POLICY:
Cancellations within 48 hours will incur a cancellation fee of $150. This fee is in addition to any other fees or charges associated with the completion of your photography booking.
RESCHEDULING – You may reschedule either your session date or your in-person sales appointment one (1) time for no additional fee, provided that you contact the studio at least 48 hours prior to your scheduled appointment. If you choose to reschedule your portrait session prior to being photographed, you may use 100% your session fee towards a future session fee that occurs within 6 months of your original scheduled date. If you need to reschedule an additional time, or if notice is received less than 48 hours prior to the scheduled appointment, there will be a service fee of $150 due at the time of rescheduling for each rescheduled appointment
CANCELING – If you choose to cancel your portrait session prior to being photographed and do not reschedule a future session, you will forfeit 100% of your original non-refundable session fee. If you choose to cancel your sales appointment after the session has already been photographed, you will be responsible for an additional $500 service fee for the artist’s work on the images photographed during the session.
COPYRIGHT NOTICE:
The photographs/images/works on this website along with those created by Devine Imageworks are copyrighted photographs/images/works of Devine Imageworks. The US Copyright Act protects professional photographers by granting them the exclusive reproductive rights to all images they produce. Violations include, but are not limited to, making physical copies of digital or print images, creating derivative works, scanning images, printing images from home or at any physical or online printing company, and screenshotting or copying images from our website (without prior written consent from the photographer). A PRINT RELEASE is not the same as a COPYRIGHT RELEASE. Print releases only allow copies of the images to be printed for personal, non-commercial usage. A print release does not allow for any type of commercial or for-profit usage (derivative works, professional advertisements, goods or services for resale, etc.)
CREATIVE USE DISCLAIMER:
Unless specifically told otherwise by a customer, Devine Imageworks may use any images or poses from these products/ purchases for samples, displays, promotions, advertisements, website, email, and/ or any other legitimate purposes.
DIGITAL DOWNLOADS:
Images that are purchased as Digital Downloads are provided as high-resolution, print-ready images that you can have printed by the vendor of your choice. Devine Imageworks makes no warranty or guarantee as to the quality of products that are not printed by or purchased directly from Devine Imageworks. Devine Imageworks authorizes the use, reproduction, distribution and display of such copyrighted images from the Digital Download for any lawful, personal, noncommercial purpose. Commercial use, including for advertising or creating goods or services for resale is not permitted. Customers purchasing Digital Downloads acknowledge that images purchased are copyrighted images of Devine Imageworks. Devine Imageworks neither assigns its copyright nor waives its rights for any purpose other than those expressly stated above.

The materials on this web site are provided “as is”. We make no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site. Any claim relating to this web site shall be governed by the laws of the State of New Jersey without regard to its conflict of law provisions.
IMAGE RETENTION:
Devine Imageworks will retain the original images from your photo shoot for a minimum of six months. Image files may be discarded after six months based on storage needs.
LIMIT OF LIABILITY:
Client agrees to hold harmless Timothy Devine, Devine Imageworks, and any employees in any dispute regarding any event where the client and/or their family or friends should become injured during the session or on the premises of any photography session. Client agrees that Devine Imageworks will not be held accountable for loss or damage of any personal property during their session, or while they are on location with Devine Imageworks.
PAYMENT ACCEPTED:
Devine Imageworks accepts cash, checks, PayPal, Venmo, and bank cards (processed through square). Dishonored checks will be assessed a $25 dishonored check fee in addition to the original amount.
PERSONAL CAMERA POLICY:
No personal cameras are allowed during any photography session. You may take behind-the-scenes photographs with your phone as long as the photographer clearly appears in all images that you take (and share on social media).
SATISFACTION GUARANTEE:
Devine Imageworks wants to exceed your expectations in everything we do. To that extent, we offer a 100% guarantee on all products. If you are unhappy for any reason, Devine Imageworks will refund, reshoot, or reprint your product – no questions asked. Of course, you must return the original product to receive your refund or replacement.
SESSION FEES:
The session fee includes a pre-session design consultation. The session fee includes one in-person sales appointment. The session fee does not include any digital or physical products. You will make your selections and finalize your purchase at the custom in-person sales appointment that has been scheduled for you. The session fee is non-refundable.
